Registration
The customer/contractual partner can register directly with Knauseder Event Concept - Knauseder Birgit. By registering, he/she acknowledges these General Terms and Conditions as an integral part of the contract between the
customer/contract partner and the company Knauseder Event Concept - Knauseder Birgit.

2. terms of payment
Payments must be made in advance, as part payment in advance, in cash or by
invoice in arrears, depending on the agreement. Payments not received on time entitle Knauseder Event Concept - Knauseder Birgit to withhold the services, to dissolve the contract and to claim cancellation costs according to point 3.

3. withdrawal by the client before the start of the activity

1. Cancellations must always be made in writing in order to be legally effective. In the event of cancellation from 4 weeks before the start of the event, Knauseder Event Concept - Knauseder Birgit reserves the right to charge a general compensation of 20 % of the expected turnover according to the offer. 50 % will be charged in the event of cancellation in the period of 2 weeks before the start of the event and 80 % in the event of cancellation 1 week before the start of the event. This does not affect the right to claim any costs incurred to date in connection with the preparation of the event. In the event of cancellation on the day of the event, 100 % shall be invoiced. If the number of participants booked is not reached on the day of the event, at least 85% of the agreed number of personswill be invoiced.
2. Additional cancellation fees charged to us by our service partners will generally be passed on.
3. If the client is unable to participate in the activity due to late arrival or if the activity has to be cancelled for this reason, 100 % of the agreed costs will be charged. If the client can only participate to a limited extent due to the delay, no refund will be made.

4. cancellation by Knauseder Event Concept - Knauseder Birgit before
start of activity
Knauseder Event Concept - Knauseder Birgit may cancel the activity if participants give justified cause for this through actions and omissions. In this case the cancellation regulations according to point 3 apply. If weather and natural conditions, official measures, force majeure, security or other reasons make the activity considerably more difficult, dangerous or impossible, Knauseder Event Concept - Knauseder Birgit can cancel the event. The price for the activity will be refunded, costs incurred by the participant (e.g. overnight stay, travel etc.) will not be credited to Knauseder Event Concept - Knauseder Birgit
under any circumstances.

5. programme and price changes or cancellation of the activity
The right tomakeprice and programme changesbefore conclusion of the contract
is expressly reserved. Changes will be announced at the time of booking. After conclusion of the contract Knauseder Event Concept - Knauseder Birgit reserves the right to change or cancel the programme after - 2 -
conclusion of the contract, even during the activity, if weather and/or natural conditions, official measures, force majeure, security or other reasons make this necessary. If a significant change is made to a contractual point before the start of the activity or if the change to the programme leads to a price increase of more than 10%, the participant can withdraw from the contract. In the event of a programme change during the activity, Knauseder Event Concept - Knauseder Birgit shall endeavour to offer a substitute service of the same value as far as possible.

6. cancellation of the activity by the customer
If the participant cancels the activity or leaves it prematurely, there will be no refund
. Any additional costs shall be borne by the participant.

7. conditions of participation, liability
Participation in certain activities constitutes a dangerous activity. The
exercise may entail risks that inevitably arise from this sport. By signing, the participant confirms that he/she meets the requirements for the exercise of the activities and that there are no impediments in his/her person and health that could prevent the exercise. An average level of physical fitness is required, as the performance of certain activities of Knauseder Event Concept - Knauseder Birgit involves mental and physical strain. The contracting parties expressly and irrevocably exclude any liability for incidents during or after the activity which can be derived from the participant's state of health or which affect the participant's health. The exclusions of liability agreed in this contract do not only concern claims against the organisers but also against employees or helpers of Knauseder Event Concept - Knauseder Birgit. Knauseder Event Concept - Knauseder Birgit shall only assume liability for the equipment provided by it and its own services, but no liability beyond this. The instructions of the employees/helpers of Knauseder Event Concept - Knauseder Birgit are to be followed. Persons with conspicuous behaviour (e.g. alcohol or drugs) may be excluded from the activity.
Pregnancy, high blood pressure, heart problems, increased risk in the cardiovascular system, damage and/or hypersensitivity to the musculoskeletal system exclude participation in certain activities (e.g. guest bobsleigh ride, racing bobsleigh ride, wok ride, summer bobsleigh ride, biathlon challenge, etc....). No liability is accepted for transport by lorry for certain activities. The participant/customer/contractual partner confirms with his/her signature that he/she has read and fully understood the instructions and conditions for the implementation of the activities. The participant/client/contractual partner expressly excludes any liability under civil law on the part of Knauseder Event Concept - Knauseder Birgit for damages incurred by him/her, be they of a psychological, physical, material or any other nature, as he/she is fully aware of the risk. Additional provisions: For persons under 18 years of age, a ride in the 4-person wok is prohibited. For persons under 12 years of age or a body height of 130 cm, a ride on a summer or guest bobsleigh is prohibited. For persons under the age of 14, a ride on the racing bobsleigh is prohibited. All participants in a bobsleigh or wok ride must wear a crash helmet. The wearing of sturdy shoes and winter clothing is mandatory for guest bobsleigh, racing bobsleigh and wok riding.

8 Insurance
Knauseder Event Concept - Knauseder Birgit is insured by the organiser's liability insurance. The participants/contractual partners/customers are not insured by Knauseder Event Concept - Knauseder Birgit and must ensure sufficient health and accident insurance cover.

9. complaints
Should the customer have cause for complaint or suffer damage, these must be immediately notified in writing to Knauseder Event Concept - Knauseder Birgit and must be confirmed on site. A third party service provider is not entitled to acknowledge claims. Knauseder Event Concept - Knauseder Birgit will endeavour to remedy the situation within the framework of the programme and possibilities. If no remedy or only insufficient remedy is provided or if the customer wishes to assert claims for damages, the customer must submit his claims in writing to Knauseder Event Concept - Knauseder Birgit within 4 weeks after the contractual end of the activity. His complaints must be accompanied by the confirmations of the service provider and any evidence. In the event of late or omitted complaints during the activity or late submission of the
claim to Knauseder Event Concept - Knauseder Birgit, all claims shall be forfeited.

10.liability
Failure of performance, reduced performance
Knauseder Event Concept - Knauseder Birgit shall compensate the customer within the framework of the general provisions for the reduced value of agreed but not performed services or poorly performed services, insofar as an equivalent substitute service could not be provided on site and there is fault on the part of Knauseder Event Concept - Knauseder Birgit or the auxiliary persons. Exclusions of liability As a participant/customer/contractual partner, I acknowledge the exclusion of liability of the company
Knauseder Event Concept - Knauseder Birgit as well as all persons working for the organiser and persons and organisations connected with the implementation for personal injury, property damage and financial loss occurring before, during and/or after the event. If Knauseder Event Concept - Knauseder Birgit legitimately transfers the execution to a third party, Knauseder Event Concept - Knauseder Birgit shall not be liable for the latter's actions and omissions.
If the participant does not follow the instructions of Knauseder Event Concept - Knauseder Birgit, the activity leader, any liability on the part of Knauseder Event Concept - Knauseder Birgit shall lapse.

11. mediation of services
When mediating services (services which Knauseder Event Concept - Knauseder Birgit does not carry out itself) to a partner company or third party, Knauseder Event Concept - Knauseder Birgit is not liable to its customers for the provision of the mediated service but the respective organiser/provider. A careful selection of the "experience partner" is made. The performance of the mediated service is based on the terms and conditions of the partner company or third party.

12.Applicable law and place of jurisdiction
Austrian law is applicable, the parties agree that the place of jurisdiction is
Innsbruck.subject to change.
